Oscar-winning screenwriter Frank Pierson dies

LOS ANGELES (AP) ? The Oscar-winning screenwriter of "Dog Day Afternoon" and "Cool Hand Luke" has died.

Frank Pierson's family says he died of natural causes Monday in Los Angeles after a short illness. He was 87.

He won an Oscar for writing 1975's "Dog Day Afternoon" and was nominated for his screenplays for "Cool Hand Luke" and "Cat Ballou." He wrote and directed 1976's "A Star is Born."

Perhaps Pierson's most famous line was for "Cool Hand Luke": "What we've got here is failure to communicate."

He most recently worked as a writer and consulting producer on TV's "Mad Men" and "The Good Wife."

Pierson served as president of the Academy of Motion Picture Arts and Sciences, which released the news of his death Monday, from 2001 to 2005 and served as governor of its writers branch for 17 years. He is survived by his wife, two children and five grandchildren.

It was effing hot this weekend. Like 100 degrees. I put on my swimsuit and hobbled on out to the backyard where I spent the afternoons tanning and cooling off in the pool.

Thank God I'm allowed to do water walking. Yes I'm 90.

Basically, it was glorious.

Pretty sure my neighbors officially think I'm a psychopath. The dogs kept bringing their stupid, completely slobbered toys and dropping them on me as I was tanning. So naturally, after tossing the toy a million times, I told them no, and shooed them away. But do dogs listen? No. At least not mine. Mine proceeded to drool ALL over me which resulted in me yelling at them repeatedly and possibly threatening to drown them if they didn't go away, all while the neighbors had an open house. Welcome to the lane! I'm boss at making fantastic first impressions. It's a gift, really.?

I've been scrapbooking away! I'm re-opening my etsy shop here pretty soon. I make pre-made scrapbooks and 2 page layouts. Can't wait to show you guys what I've been working on. Sister came home last week and was all "want to go to the mall with me real fast?" And I was all, "ummm no. But I guess I will." So, I rode with her, but ended up just waiting in the car while she ran in, because crutches in the mall when you're in a hurry is the worst idea ever. So, there I was, just chillin in the car listening to a little Tim McGraw, when the car literally started shaking. Not like back and forth, ohmygoditsanearthquake?shake, but steady up and down rocking, kind of shake. I turned around and sure enough, there was a guy sitting on my bumper. Homeskillet was rockin' out to his own music and decided it was a good place to have a jam session. Seriously the most ghetto mall ever. I spent the rest of the time on the floor of the car texting sister to hurry up. God, what is my life?!

It has been so wonderful spending time at home with my beautiful family. I must say, if this summer has taught me anything, it's that home isn't our house or this street we live on. I know it's cheesy, but home really is just being surrounded by the people that love and support you. I guess it doesn't matter where we live or where the future takes us, as long as my wonderful family is around, well, there's home for me.?

At physical therapy this week, my physical therapist had me do all of my random leg exercises that I swear to God make me feel like I'm in a stripper's training course. I lay on a table and open and close my legs and twist in all sorts of weird ways. (I don't even know how strippers do it. Even fully clothed, my ladyhood feels like its on display.) Anyways- my butt muscles. They don't feel anything. At all. The whole point is to strengthen my butt muscles, but they're all "we don't want to work, but thanks." So then physical therapist suggests we do electromagnetic stimulation on my butt. To which I responded, "I'm sorry what? You want to do what, where?" Then he explained that it would be the same machine that they hook up to my leg every week, but all I could get out was "You want me to lay on a table while you shock me in the ass? Yeah we're not doing that, but thanks." Physical therapist is so good for putting up with me and my.... ummm... sassyness. I love him. But anyways, to make the picture relevant, I sent this picture of my reaction to my sister when I told her the story. ?So voila. My eyeball and a really odd story about my butt. You're welcome.

Johan Santana To DL: Mets Ace On 15-Day Disabled List With Ankle Injury

NEW YORK -- Johan Santana is taking a break, whether he wants to or not.

The two-time Cy Young Award winner was placed on the 15-day disabled list Saturday with a sprained right ankle, the latest setback for the fading New York Mets since the All-Star break.

Santana has struggled mightily since Reed Johnson of the Chicago Cubs stepped on his foot July 6 on a play at first base. The left-hander was hit hard for the third straight start Friday night in a 7-6 loss to the Los Angeles Dodgers, and manager Terry Collins said afterward the team was looking for a way to get some "energy" back in his arm.

Santana missed last season following major shoulder surgery. He is 6-7 with a 3.98 ERA in 19 starts covering 110 2-3 innings.

"We knew in spring training that there might be a time this summer when he has to get shut down," Collins said. "Well, now is going to be that time."

General manager Sandy Alderson said Santana probably won't pitch again until at least Aug. 7, when the Mets return home from an 11-game road trip out West.

"Definitely, it's tough. I didn't want to go on the DL. I want to keep pitching and competing," Santana said. "They decided it's better for me to take some time off and that's what we're going to do."

New York is also missing starter Dillon Gee, who had surgery last week on an artery in his pitching shoulder after a blood clot had formed there. Gee will be sidelined for at least a couple of months and there's a good chance he'll miss the rest of the season.

Miguel Batista (1-3), a 41-year-old journeyman who has pitched mostly in relief this season, started in Gee's place Saturday. He lasted only three innings in an 8-5 loss to ex-Met Chris Capuano (10-5) and the Dodgers.

Right-hander Jeremy Hefner was recalled from Triple-A Buffalo to help an overworked bullpen. The Mets will bring up reliever Elvin Ramirez on Sunday.

Santana became the third member of New York's opening-day rotation to go on the disabled list. Mike Pelfrey had season-ending elbow surgery in May.

"Johan I think has exhibited the effects of 100 innings and a sore ankle the last couple of starts," Alderson said. "We think that the ankle injury may have led to some general fatigue in his shoulder, specifically. And in light of the surgery and where he's been and what he's accomplished, we've gotten to the point where he probably needs to get that ankle right and get back to the point where he feels confident about pitching."

Alderson said the Mets haven't decided how to fill out their depleted rotation going forward. Santana's next turn would have been Wednesday against Washington ace Stephen Strasburg.

"We'll make a decision on the rotation in the next couple of days," Alderson said. "We're now filling two spots instead of one."

Hefner, a starter at Buffalo, has made three starts for New York this season. Another option is prized prospect Matt Harvey, though the Mets have been cautious about rushing him up from Buffalo.

They may need a boost if they want to stay in contention. New York (47-47) has lost eight of nine to fall back to .500 for the first time since it was 13-13 after play on May 4.

"We're not done," Santana said. "We're just going to continue playing and hoping to put some wins together again."

With the non-waiver trade deadline looming July 31, the Mets must quickly determine whether it would be wise to make a move.

"The presumption here is that we're buyers, and it has been," Alderson said. "Realistically, the next seven, eight or 10 games become important for us."

The 33-year-old Santana is 0-3 with a 13.50 ERA in his last three outings. He has given up 19 runs, 28 hits and six homers over 12 2-3 innings, the worst stretch of his stellar career. He was pulled for a pinch-hitter after throwing 72 pitches in three innings Friday night.

"We sat for quite a while this morning in discussions with Johan and the training staff and we've pretty much determined that the ankle issue is bigger than anybody has realized," Collins said. "Ever since he had the ankle injury he's lost ? basically his command has not been there, due to the fact that we don't think he can land properly. He's using all arm to pitch, causing some fatigue in his shoulder. No pain, there's just nothing there."

Santana insisted his shoulder is OK.

"It's just that when you start compensating and doing other things you get different results, especially with command of your pitches," he said. "I feel fine, it's just that you've got to (have) time to recover."

So the stint on the DL is designed to give Santana rest, heal his ankle and rebuild his arm strength. Alderson said no tests are planned.

"As I told Johan, I don't think anyone should be surprised by this," the GM said. "Certainly no one as competitive as Johan wants to go on the disabled list. I think he recognized that was probably the best resolution in this case."

Santana is 3-5 with a 6.54 ERA in eight outings since throwing a career-high 134 pitches June 1 against St. Louis to finish off the first no-hitter in Mets history. Some still wonder whether that one-night workload led to his recent slump, but Alderson doesn't think so.

"I think really at this point it has more to do with the ankle," he said.

MADRID (AP) ? The World Wildlife Fund's branch in Spain has ousted King Juan Carlos as its honorary president ? a title he'd held since 1968 ? after deciding his recent elephant hunting safari was incompatible with its goal of conserving endangered species.

The announcement Saturday was the latest in a string of bad news for Spain's royal family, which has been embarrassed by legal and other scandals.

The fund said in a statement that "although such hunting is legal and regulated" it had "received many expressions of distress from its members and society in general." It said members voted at a meeting Saturday in Madrid to "to get rid of the honorary President" by a substantial majority of 226 votes to 13.

The Royal Palace declined immediate comment on the announcement.

Many Spaniards were dumbfounded when news broke in April that the king had made a secret journey to hunt elephants in Botswana even though it was widely known he was president of the Spanish branch of the fund.

Such an opulent indulgence also angered Spaniards at a time when national unemployment hovers around 25 percent, the economy is contracting and there are fears the country may need an international financial bailout.

The Spanish public learned of the safari only after the king had to fly back in a private jet to receive emergency medical attention for a broken hip suffered during the trip.

In an unprecedented act of royal contrition, a sheepish Juan Carlos apologized, saying as he left the hospital: "I am very sorry. I made a mistake. It won't happen again."

It was a poignant moment because the royal family had been under intense media scrutiny for all the wrong reasons.

The king's son-in-law, Inaki Urdangarin, is a suspect in a corruption case, accused of having used his position to embezzle several million euros in public contracts through a supposedly not-for-profit foundation he'd set up.

Over Easter, the king's 13-year-old grandson, Felipe Juan Froilan, shot himself in the foot with a shotgun, even though Spanish law dictates you must be 14 to handle a gun.

The king on Tuesday decided to take a pay cut in solidarity with civil servants who are to lose their traditional Christmas bonuses as part of the government's most recent austerity drive.

The salaries of Juan Carlos and Crown Prince Felipe will be reduced about 7 percent ? to about 272,000 euros ($334,000) and 131,000 euros ($160,000) respectively ? in line with government policy, the Royal Palace said.

The king and prince acted voluntarily in cutting their salaries, the palace said.

A first: Cheers not jeers at Apple product debut in China

People lined up outside Beijing's Apple store for their chance to buy the latest iPad. NBC's Ed Flanagan reports.

BEIJING ? This time, Apple and its devoted Chinese customers weren?t taking any chances.?

Wary of a repeat of the iPhone 4S debacle in China in January, when Apple?s release led to scuffles and even an egging of its flagship Beijing store by angry hordes after it was forced to cancel sales due to the crowds, Apple?s managers here put their heads together and came up with a new strategy for dealing with the crowds.

They came up with a reservation style of ordering already in use in other countries like the United States. However, this time they decided to institute the reservation system as the only way to purchase the latest iPad, which features a sharper display and better camera than previous versions, for its China debut.

Around 50 customers quietly lined up outside the store in Beijing Friday morning, staring intently inside the store as an almost equal number of jovial blue-uniformed employees clapped, sang and danced in the minutes before opening.

It was a far cry from the sheer bedlam unleashed earlier this year when the iPhone 4S went on sale. On that day, many in the crowd were scalpers who local media said hired scores of people to line up with them to purchase the precious phones to be sold in other Chinese cities for a higher rate.?

?It shouldn?t take too long to learn how to use?
First in line to purchase the new iPad in Beijing on Friday was Ye Huafei, a 34-year-old software engineer who arrived at the store just two hours before opening. Forced to purchase this new iPad after his iPad2 had been poached by his mother to watch TV dramas, Ye elected to arrive early to pick up his new iPad so he could bring it to work and show it off to his colleagues.?

?It feels great to be first,? said Ye. ?The scene here is fantastic.??

Apple?s new product releases tend to attract a younger, status-conscious crowd in China. But mixed in the opening throng of customers was Mr. Wu, an older customer who coyly put his age at ?under 65.?

Wu owns an iPhone 4S, but decided to upgrade to an iPad because he is getting older and his eyes have been getting tired looking at the small screen.

With new iPad in hand, the first thing Wu did was walk over to a nearby counter where an Apple employee was offering hour-long lessons to new customers on how to use their new tablets.

Fresh from class, Wu excitedly showed us what he had learned.

?It shouldn?t take too long to learn how to use, I have a strong base,? he said happily. ?I have an iPhone 4S and I know how to use that very well.?

He will need to learn quickly. With his purchase, Wu became the first member of his extended family to use an iPad.

One thing he did not take long to discover was the free WiFi at the Apple store. With no Internet connection at home, Wu decided to save money by not purchasing a 3G-capable iPad and bought a wifi-capable tablet instead.

Pointing to the Apple store behind him, Wu said, ?I?ll just come here. My home is very close?I spent the money, so I should enjoy the product and the service.?

The ?it? product
Like in much of the rest of the world, Apple?s phones and tablets have become the ?it? product to own in China, which is now Apple?s second-largest market after the United States. But with just five official Apple stores in the country, even a robust gray market for Apple products cannot always keep up with demand, especially in the days immediately following a high-profile release.

Apple was forced to delay the mainland release of the latest iteration of the iPad due to a lawsuit brought by a company claiming to own the iPad trademark in China. So the company had time to experiment with the new reservation system in Hong Kong for its iPad debut last March and found it effective in dealing with scalpers and the crush that has followed previous product launches.

Since the Cupertino, Calif., company settled the trademark issue for a reported $60 million earlier this month, mainland Chinese customers were invited yesterday to start registering to purchase the iPad at a special website created by the tech giant. Upon filling out the online form, customers were given a designated time to pick up their new iPads.

On Thursday morning, NBC News attempted to log onto the website when it opened at 9 a.m. but the usual crowd of customers apparently crashed the site. The site was up and running again within the hour.

Questions about whether news of the change in policy had gotten out to the public and to poachers were answered early Friday morning when the plaza outside the Apple store in Beijing was mostly empty.

Reports from the other four Apple-owned stores also showed smooth sales.

Ingredients

• 4 medium red potatoes
  
• 2 cups frozen peas
  
• 1/4 pound gluten-free elbow pasta, cooked and drained
  
• 1/2 cup Soy-Free Veganaise
  
• 2 Tbsp. balsamic vinegar
  
• 1 Tbsp. olive oil
  
• 1 red bell pepper, finely chopped
  
• 1/2 cup loosely packed fresh dill leaves, torn into pieces
  
• ? cup cashews
  
• ? tsp. sea salt
  
• ? tsp. freshly ground black pepper
  

Instructions

• Place potatoes in a small stockpot; cover with cold salted water. Cook over high heat, bring to a boil then reduce to medium heat and cook until fork-tender, about 8-9 minutes. Remove from heat; drain in a colander and set aside to cool. Cut cooked potatoes into 3/4-inch cubes.
  
• Fill a small saucepan with salted water, and bring to a boil. Add frozen peas; cook according to package, then drain. In a large bowl, combine cooked peas, potatoes and elbow pasta. Set aside.
  
• In a separate medium mixing bowl combine Vegenaise, balsamic vinegar and olive oil; mix well to combine. Fold balsamic mixture into potato and pasta salad. Add red bell pepper, fresh dill, cashews, sea salt and pepper; gently toss to combine.
  
• Transfer to a serving bowl and serve immediately or cover and store in the refrigerator until ready to serve.
  
• Serve chilled or at room temperature.

Verizon's wireless glows, broadband hits wall

NEW YORK (AP) ? Verizon Communications Inc., parent of the country's largest cellphone carrier, on Thursday said its net income rose 13 percent in the second quarter as its wireless arm pulled in record profits.

Verizon has one foot in the wireless world and one in the traditional, wired phone-company world. In the latter, results were notably weaker. Like other phone companies, Verizon is losing landlines, but has been compensating to some extent by signing up broadband customers. In the second quarter, that trend faltered, as it gained a net of just 2,000 broadband customers ? the worst result in four years.

Chief Financial Officer Fran Shammo said the weak showing was in part due to Verizon ending the sale of DSL connections to people who don't have a landline phone account. The effort is part of an attempt to improve profitability. The wired-connection side of Verizon, which still employs nearly half of its workers, is running just above break-even.

Verizon has upgraded part of its phone network with optical fiber, a service it sells as "FiOS." In locales where it hasn't done that, it's losing out to cable companies, who can offer much higher speeds than Verizon can with DSL.

The poor showing comes after Verizon Wireless struck a deal to market cable broadband from Comcast and Time Warner Cable in its stores, a move consumer advocates see as a capitulation by Verizon that will leave many areas with just one viable choice for home broadband: cable.

Shammo said putting profits over growth also means raising FiOS prices, resulting in fewer new FiOS subscribers.

Overall, the New York-based phone company earned $1.83 billion, or 64 cents per share, in the April to June period, up from $1.61 billion, or 57 cents per share, a year ago.

The latest earnings match the average forecast of analysts polled by FactSet.

Revenue rose 3.7 percent to $28.5 billion, also in line with analysts' expectations.

The results come after Verizon shares hit a 10-year high of $46.41 on Wednesday. In pre-market trading Thursday, the shares retreated 72 cents, or 1.6 percent, to $45.17.

Verizon Wireless gained a net 1.2 million subscribers ? a strong result in an industry where subscriber gains have tapered off now that nearly everyone has a cellphone. Of the new subscribers, 888,000 were on contract-based plans, which are the most lucrative.

Verizon Wireless has 94.2 million retail subscribers, making it the biggest wireless carrier in the nation. Arch-rival AT&T Inc. is set to report quarterly financial results on Tuesday.

The profit margin at Verizon Wireless was the highest ever, as average monthly fees for contract-signing subscribers rose 3.7 percent from last year, to $56.13. Verizon is benefiting from the growing popularity of smartphones, which come with data fees.

Three weeks ago, Verizon Wireless introduced the biggest-ever change to wireless price plans, ditching most of its plans in favor of one that allows people to share a data allowance over up to ten devices.

Shammo said customers have given the plan a positive reception, and it has even tempted subscribers who have stuck to their old "unlimited data" plans to switch.

Consumer groups have said the plans amount to a price hike, but analysts believe it's a price cut, at least in the short term. On the conference call, the CFO said the new plan isn't expected to cut into service revenues this year.

Verizon Communications owns 55 percent of Verizon Wireless. The rest of the profits flow to partner Vodafone Group PLC of Britain.

Chief of troubled brokerage left suicide note

WASHINGTON (AP) ? Employees of an Iowa-based brokerage firm that has been unable to account for $220 million in customer money found their boss in his car at company headquarters, with a tube connecting the vehicle's tailpipe to the interior, authorities said Tuesday.

Peregrine Financial Group filed for bankruptcy protection Tuesday, a day after founder and Chairman Russell Wasendorf Sr. was discovered with a suicide note that prompted investigators to notify the FBI, which is conducting a preliminary inquiry.

Black Hawk County Sheriff Tony Thompson declined to discuss the contents of the note, except to say it was "a form of documentation that caused alarm, at least concern for us to get federal authorities involved."

Emergency crews were not sure how long Wasendorf had been in the running car. A police report said he was breathing but incoherent when rescuers took him to an Iowa City hospital, where he was reportedly in a coma.

The day after Wasendorf's suicide attempt, the Commodity Futures Trading Commission, the company's top federal regulator, filed fraud charges that accused him and his firm of misusing customer funds and failing to keep them separate from company money. Later Tuesday, the company filed for Chapter 7 bankruptcy protection in federal court in Chicago. The bankruptcy filing was signed by Wasendorf's son, Russell Wasendorf Jr. The younger Wasendorf was the company's president and chief operating officer.

The events are sure to bring more scrutiny to an industry still smarting from the implosion of MF Global, former New Jersey Gov. Jon Corzine's futures firm, which was missing billions in customer cash when it collapsed in October.

Peregrine customer Kevin Davey said the allegations, if true, violate a bedrock principle of futures trading. Traders are confident in their brokerages because they believe that nobody will touch the money in customer accounts.

"The whole industry is based on that," Davey said.

Peregrine helped customers buy, sell and trade foreign currency and futures and options ? investments whose value changes based on the expected future price of food and energy commodities and other investments.

The commission said Peregrine falsely reported to the agency that it held $220 million in customer funds when it actually had only $5.1 million. The agency is asking the court to freeze the firm's assets and appoint a receiver to take over Peregrine. Regulators forced Peregrine to freeze customer accounts on Monday.

In a statement to clients, the firm acknowledged the elder Wasendorf's suicide attempt but provided no information on his condition, saying only that his actions provoked investigation of "some accounting irregularities."

Neither a spokeswoman for Peregrine nor the firm's attorneys responded to a call seeking comment.

FBI spokeswoman Sandy Breault said the bureau is gathering facts on the matter as a first step before launching a possible full investigation.

Peregrine was sued in February in federal court in Minnesota over the company's relationship with customer Trevor Cook, who is now serving a 25-year sentence for his role in what the lawsuit called "one of the largest Ponzi schemes in Minnesota history."

The receiver accused Cook and his confederates of stealing more than $190 million from more than 1,000 investors, many of whom were completely ruined financially. Wasendorf's company allowed Cook to open and manage trading accounts "in the face of overwhelming red flags of fraud or insolvency," the lawsuit said.

Cook and his associates ultimately lost more than $30 million.

The suit alleged that Peregrine should have known since Cook became a customer in 2006 that he was "a suspicious and high-risk customer and business partner." In 2001, Cook was sanctioned by the National Futures Association for "conduct reflecting a lack of honesty." The suit is pending in federal district court.

Also in February, the company and its executives paid $700,000 to settle charges by the futures association, the regulator that shut it down this week. The association alleged that Peregrine had failed to supervise brokers that made deceptive sales pitches and sought big commissions at the expense of customers.

That helped convince Phil Flynn, at the time a broker with Peregrine, to leave the firm after five years.

"For me, that was a big red flag to start looking for another firm," said Flynn, who now works with Price Futures Group in Chicago. "My only regret is that I didn't act faster."

Flynn said there were other strange things about working for Peregrine: He learned about the company's problems in newspapers, not directly from management.

And he said Wasendorf Sr. gave an awkward, rambling speech at the company's most recent Christmas party about his early business career and what it takes to become a success.

"It was kind of a downbeat thing for a Christmas party, kind of out of place and weird," he said.

Flynn said some firm employees referred to Wasendorf's inner circle as "Wasendorfians." He said the chairman was often surrounded by underlings who treated him "like he was the rock star of the firm, with great deference."

Wasendorf built an $18 million headquarters for the company that included a daycare center, a Montessori School for employees' kids and free breakfast and lunch, Flynn said.

"It was almost unbelievable," he said of the facility's opulence.

After the failures of MF Global and Peregrine, Peregrine customer Davey said traders are beginning to lose faith in regulators' ability to safeguard their money.

MF Global filed for bankruptcy protection in October after it was crippled by disastrous bets on European debt. A bankruptcy trustee is still trying to recover $1.6 billion in money missing from MF Global's client accounts.

"People's confidence was shaken last October," Davey said. "Now it's really put a dagger into a lot of people's hearts."

He said he has talked to people who might stop trading because they don't know whom they can trust with their money.

"The effect is going to be on some of these smaller retail accounts that provide a fair amount of volume and money to the markets," he said. "They might dry up and say 'I'm not even going to try playing this game.'"

Peregrine had assets of $500 million to $1 billion and liabilities of $100 million to $500 million, according to its bankruptcy filing. It had between 10,000 and 25,000 creditors.

Flynn said he was amazed that regulators failed to catch the problem earlier, given the scrutiny of firms like Peregrine after MF Global's downfall.

"It's mind-boggling to me," he said. "They're talking about new regulations, but that doesn't get to the crux of the problem. The crux of the problem is, where's the money? You say you have X amount of dollars. Where is it?"
